In consideration of being given the opportunity to participate in the Engineering Challenge Cup 2026 (“ECC 2026”), I, as Skipper, Co-skipper or Crew member (“Member”) of the yacht entered in ECC 2026 (“Yacht”), and on behalf of my personal representatives, assigns and heirs, hereby acknowledge and agree as follows:
1. Acceptance of responsibility and indemnity
a) Sailing activities involve risks and dangers of bodily injury, including permanent disability, death and property damage, as well as other risks or losses not known or not foreseeable at this time (“Risks”).
b) These Risks may be caused by my own actions or omissions, the actions or omissions of other Members, other participants, organisers of ECC 2026, or by the conditions in which ECC 2026 takes place.
I hereby fully accept and assume all such Risks, howsoever caused, as a result of or in connection with my participation in ECC 2026.
I further agree to indemnify and hold harmless:
- the ECC 2026 Commodore and ECC Committee
- the companies they work for and their affiliated companies
- their directors, officers and employees
- the members of the ECC 2026 Organizing Committee
- the partners of the ECC 2026 Organizing Committee (including, but not limited to, the ECC Coordinator and the event agency)
- the ECC 2026 sponsors
- and anyone acting on behalf of the above
(collectively referred to as the “Indemnified Parties”)
from any claims for property loss, costs or damages, including litigation expenses and attorney fees, except in the case of wilful misconduct or gross negligence of the Indemnified Parties.
2. Decision to participate / Seamanlike behaviour
Participation in ECC 2026 is entirely my own decision.
If I observe any condition that I consider unacceptably hazardous or dangerous, I will refuse to participate or will discontinue participation until such condition has been resolved to my satisfaction.
I am fully responsible for adhering to all required seamanlike behaviour and safety instructions during ECC 2026.
3. Rules and instructions
The establishment of any rules or instructions by the Indemnified Parties does not limit or reduce my responsibility as a participant in ECC 2026 under this Agreement and Disclaimer or otherwise.
4. Insurance
It is entirely my responsibility to ensure that I maintain adequate third-party liability insurance during and after ECC 2026.
5. Pictures and videos
I acknowledge and agree that during ECC 2026, photographs and video recordings may be taken, including images of the Skipper and crew.
These materials may be used for:
- event promotion
- sponsorship purposes
- documentation of the event
- publication on the ECC website and related media
By participating, I transfer all rights related to such images and recordings to:
- the ECC 2026 Commodore and ECC Committee
- the ECC 2026 Organizing Committee
- the partners of the ECC 2026 Organizing Committee (including the ECC Coordinator and event agency)
- and anyone acting on their behalf
Declaration
I confirm that I have carefully read this Agreement and Disclaimer and fully understand its contents.
